¶1Heard learned counsel for the petitioner and Sri Babu Ram Shukla, Advocate holding brief of Sri Satya Prakash Tiwari, learned counsel for the opposite party.
¶2It has been informed by learned counsel for the opposite party that the order of the Writ Court has been complied with in its letter and spirit as the petitioner has been paid his admissible dues.
¶3However, learned counsel for the petitioner has stated that the authority has not passed any order in respect of making payment of interest on delayed payment in terms of order of the Writ Court.
¶4On that, Sri Babu Ram Shukla, learned counsel for the opposite party has stated that there is no provision to make payment of interest on delayed payment.
¶5Be that as it may, when the entire dues has already been paid to the petitioner, then there is no purpose to keep this contempt petition pending any longer. However, the opposite party must issue a letter to the petitioner apprising that there is no provision of making payment of interest on delayed payment so that if the petitioner feels himself aggrieved from that order, he may challenge the same before appropriate court of law if that order is liable to be challenged.
¶6In the wake of aforesaid development, nothing remains to be adjudicated in the instant contempt petition.
¶7Accordingly, the instant contempt petition is dismissed.
¶8Notice, if any, stands discharged. [Rajesh Singh Chauhan,J.] Order Date :- 23.11.2023 Suresh/ High Court of Judicature at Allahabad, Lucknow Bench
