¶1The present petition has been filed challenging the order dated 13.04.2010 passed by the prescribed authority under Section 10 of the U.P. Land Ceiling Act as well as the order dated 15.6.2013 whereby the appeal preferred by the petitioner was dismissed.

¶2The contention of the learned counsel for petitioner is that the petitioner was served with a notice under Section 10 (2) of the U.P. Land Ceiling Act calling upon the petitioner to give reply as the notice was not in accordance with law. As the notice was not in the prescribed format and did not contain material particulars and was blank in certain aspects, the petitioner moved an application that the relevant details as proposed in the show cause notice be supplied. The said application was rejected by holding that the petitioner shall file his reply and all the issues including the blank entries would be considered subsequently. Against the said order, the petitioner preferred an appeal, which came to be dismissed on 15.06.2013 holding that the order impugned was interlocutory in nature and an appeal would not lie.

¶3Considering the submission made at the Bar, the present writ petition is disposed of directing the respondents to supply the necessary particulars in terms of the provisions of the rules in respect of notice issued to the petitioner and thereafter proceed to complete the adjudication with all expedition in accordance with law.
