The issue agitated in the present Public Interest Litigation may be well appreciated if instituted before the forum having territorial jurisdiction over the area in which the Dam in question is situated. Instruction from the District Authorities as regards the implementation of the Scheme or payment of the compensation can better be explained by the District Authorities who are not within the territorial jurisdiction of this Court. Although grievance against the State has also been partly raised but for consideration of the grievance in its entirety, it would be appropriate that the issue raised in the present PIL may be presented before the forum having territorial jurisdiction i.e. High Court Allahabad. With the liberty as above, the present Public Interest Litigation is permitted to be withdrawn. Accordingly, the Public Interest Litigation is dismissed as withdrawn.
