Heard learned counsel for the petitioner and learned Standing Counsel for the State. The writ petition was filed with the prayer to direct the Respondent No.1 to issue recovery certificate. It has further been prayer to direct the respondent no.2 to execute the recovery certificate ssued by the Respondent No.1. In these circumstances, Secretary, Uttar Pradesh Real Estate Regulatory Authority - Respondent No.1 is directed to issue the recovery certificate to the District Magistrate within a period of three weeks, thereafter, the District Magistrate, Lucknow, i.e., Respondent No.2 shall ensure recovery of the same within three months from the date of production/receipt of certified copy of this order and shall ensure that because of any apathy at his end the petitioner is not compelled to approach this Court again.
