Petitioner has approached this Court claiming that land is being purchased in his village with the consent of the farmers however, petitioner claims that proper compensation is not being fixed with regard to his land. Learned Standing counsel states that while fixing rate of the land of the petitioner, the rate provided to other farmers surrounding land of petitioner as well as the circle rate both will be taken into consideration. It seems to be a reasonable statement by the State and is taken on record. The respondent No.4-Sub Divisional Magistrate/Special Land Acquisition Officer, Tehsil Ikauna, District-Shrawasti is directed to decide the rate with regard to the land of the petitioner taking into consideration the rate given to other farmers surrounding the land of the petitioner as well as circle rate applicable in this case.
