Court No. - 10 Case :- CRIMINAL MISC. WRIT PETITION No. - 8988 of 2023 Petitioner :- Smt. Anila Mishra And Another Respondent :- State Of U.P. Thru. Secy. Home Deptt. Civil Secrt. Lko. And Others Counsel for Petitioner :- Surya Narayan Singh,Satya Narain Mishra Counsel for Respondent :- G.A. Hon'ble Mrs. Sangeeta Chandra,J. Hon'ble Narendra Kumar Johari,J. Heard learned counsel for the petitioners and learned A.G.A. for the State. This petition has been filed with the following main prayer:- "To issue a writ, order or direction in the nature of certiorari thereby quashing the impugned First Information Report dated 04.11.2023 Under Sections 147, 498-A, 323, 506 and 306 IPC, P.S. Dahi, District Unnao. The copy of impugned First Information Report being annexed here with as marked Annexure No.1 to this Criminal Misc. Writ Petition." It has been submitted by the learned counsel for the petitioners that the husband of the deceased is absconding. The petitioner no.1 is the mother-in-law and the petitioner no.2 is the father-in-law of the deceased. They were living separately and they had no concern with the suicide of the deceased daughter-in-law. There is no documentary evidence annexed to the writ petition to show that they had a separate living from their son and daughter-in-law. After having examined the submissions advanced by learned counsel for the parties and perused the impugned F.I.R., we are of the opinion that the impugned F.I.R. discloses cognizable offence by the petitioners, hence, no interference is called for by this Court in its extraordinary power under Article 226 of the Constitution of India for quashing of the F.I.R. or for grant of any interim relief to the petitioners and accordingly, the present writ petition is dismissed.
