Judgment
Court No. - 17 Case :- WRIT - C No. - 9927 of 2023 Petitioner :- Vindesh Kumar Singh Respondent :- Allahabad Bank Now After Merger Indian Bank, Thru. Its Zonal Manager Lko. And 2 Others Counsel for Petitioner :- Prashant Agarwal Counsel for Respondent :- Anurag Srivastava Hon'ble Alok Mathur,J. Heard Shri Prashant Agarwal, learned counsel for the petitioner as well as learned counsel appearing on behalf of Allahabad Bank. In the present writ petition the petitioner has challenged the award passed by the Central Government Industrial Tribunal cum Labour Court, Lucknow dated 20.09.2022 where the challenge made by the petitioner to the order of suspension passed during the pendency of inquiry has been rejected. The Tribunal had recorded that during the pendency of the said case the final order of punishment dated 05.3.2019 has been passed against the petitioner and as a suspension order was passed during the pendency of the disciplinary proceedings, the same would be of no consequence after the order of punishment has been passed and, accordingly, dismissed his case. The petitioner in the present writ petition has also challenged the order of punishment dated
05.3.2019. It seems that the present petition has been filed against two separate and distinct cause of action, one is order of Tribunal and other is order of punishment. On the said fact being pointed out, learned counsel for the petitioner submits that he may be permitted to withdraw this petition and file separate petitions against both the said order. In light of the above, petition is dismissed as not pressed with the aforesaid liberty. Certified copy of the order dated 20.9.2022 annexed in the writ petition as Annexure - 13 be returned as per High Court Rules. Order Date :- 24.11.2023 mks
