Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties. Rejoinder affidavit filed today is taken on record. It has been submitted that earlier petitioner working on the post of Health Worker (Female) was posted in Kusafar Dariyabad, District Barabanki and was transferred to Khewali Dewa, District Barabanki vide order dated 09.11.2022 and now by means of impugned order dated 14th August, 2023 has again been transferred from Khewali Dewa, District Barabanki to Pattaunza, Suratganj, District Barabanki. It has been submitted that aforesaid transfer is against government policy dated 17th June, 2022. It is submitted that petitioner is being discriminated against, since she is being frequently transferred whereas other similarly placed persons are enjoying continued posting in a particular place from more than 10 to 15 years. With regard to her grievance, petitioner seeks liberty to file a fresh representation before the concerned authority. Considering innocuous prayer being made by learned counsel for the petitioner and without entering into the merits of the case petitioner is granted liberty to file a fresh representation within seven days from today before opposite party No. 3, i.e., Chief Medical Officer, District Barabanki. In case such a representation is filed, the same shall be decided by a reasoned and speaking order within a period of one week from the date a copy of this order is produced before the said authority. Till decision on the representation, petitioner shall not be compelled to join at the place of transfer. With the aforesaid observations, the writ petition stands disposed of.
