¶1Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties.

¶2Under challenge is order dated 24.01.2023 whereby minor penalty has been awarded to petitioner.

¶3After arguing the matter at some length, learned counsel for petitioner seeks to withdraw this petition in order to approach the U.P. State Public Services Tribunal.

¶4Considering aforesaid submission, petition is dismissed as withdrawn granting aforesaid liberty.

¶5In view of urgency indicated by learned counsel for petitioner, it is provided that in case petitioner files claim petition before Tribunal, the same shall be considered and decided expeditiously as per the time frame provided in the Act subject to cooperation by petitioner.
