Judgment

Court No. - 16 Case :- CRIMINAL MISC. BAIL CANCELLATION APPLICATION No. - 131 of 2023 Applicant :- Yasir Beg Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Civil Sectt, Lko And Another Counsel for Applicant :- Vinod Mishra,Anil Kumar,Km. Shilpi Counsel for Opposite Party :- G.A. Hon'ble Subhash Vidyarthi,J. Heard Smt Shilpi, learned counsel for applicant and Sri Jayant Singh Tomar, learned AGA-I for the State. By means of the instant application, the applicant has sought cancellation of the order dated 16.10.2023 passed by Incharge Sessions Judge, Sultanpur granting anticipatory bail to the opposite party no.2 in Case Crime No.180 of 2023, under Sections 149, 420, 467, 468 and 471 IPC, Police Station Bandhua Kala, District Sultanpur. Learned counsel for applicant has submitted that opposite party no.2 has obtained a questionaire from the district court giving wrong information regarding continuance of an injunction order. A perusal of the order dated 16.10.2023 indicates that it has been passed after taking into consideration all the relevant facts and circumstances of the case. The correctness of allegations will be examined by the trial court after hearing the parties concerned and scrutnizing the evidence on record. The allegation of obtaining a questionarie from the competent court giving false information cannot be a ground for cancellation of anticipatory bail granted to the opposite party no.2 by the Sessions Judge after taking into consideration all the relevant facts and circumstances of the case. There appears to be no good ground for cancellation of the order dated 16.10.2023 granting anticipatory bail to opposite party no.2. The application for cancellation of anticipatory bail lacks merit and the same is accordingly rejected. Order Date :- 28.11.2023 Renu/- High Court of Judicature at Allahabad, Lucknow Bench
