¶1Heard learned Counsel for the petitioner.

¶2The present writ petition has been filed challenging an award of Permanent Lok Adalat, whereby an award of Rs.1,00,000/- has been awarded to the claimant along with cost of Rs.1,000/- on account of death of the ensured which was duly covered by Kisan Durghatana Bima Yojana.

¶3On merits of the said order, the contention of the Counsel for the petitioner is that as the name of the beneficiary was not recorded in the computerized khatauni, he was not entitled for the said benefit under the terms and condition of the policy.

¶4As the said issue has already been decided by this Court in the case of Oriental Insurance Company Limited vs Smt. Channdr and others, decided on 26.08.2022 (Writ-C No.15686 of 2017), I do not find any reason to take a view different from the said judgment.

¶5In view of above, the writ petition is allowed.

¶6Let the amount, if any, deposited in this Court be remitted to the Permanent Lok Adalat along with interest accrued thereon for being disbursed to the claimant. Order Date :- 28.11.2023 akverma High Court of Judicature at Allahabad, Lucknow Bench
