This petition has been filed with a prayer for a direction for disposal of case no.C200010000001932 (Shyam Kumar vs State). Admittedly the interim order was granted in the said suit and after dismissal of the writ petition of the State in the year 2022, an application was moved by the petitioner. The proceedings of the said case has started in the month of October 2023 and

30.10.2023 was fixed as a first date. Since then, three dates have been fixed, out of which, on two dates, the case has been adjourned on the ground of strike of lawyers and condolence by the lawyers and on one date, the case could not be taken up due to paucity of time. Therefore, the contention of the learned counsel for the petitioner that the case is not being disposed of is not tenable. At this stage, learned counsel for the petitioner submits that the petition be dismissed as not pressed with liberty to file fresh in case, occasion arises in future. To which, there is no objection by the other side. So far as the other prayer is concerned, the petitioner may avail appropriate remedy as may be available to him under law.
