Sri Vijay Kumar Yadav learned counsel for the petitioner submits that this petition has been filed for a direction for disposal of Regular Suit no.555 of 2021 (Rakesh Kumar vs Surendra Kumar). Submission of learned counsel for the petitioner is that the case has proceeded exparte on 01.10.2022 but till date the same has not been disposed of whereas the perusal of the order sheet indicates that on 01.10.2022, 07.12.2022 was fixed for disposal of commission report. It appears from the typed copy of the order sheet filed by the petitioner that the objection to the said report has been filed on 07.12.2022 and thereafter also he had appeared. Learned counsel for the petitioner could not clarify that the defendant is appearing and as to whether the case is proceeding exparte. Therefore, no direction can be issued, at this stage.
