¶1Vakalatnama filed by Mr. Kishore Kumar Sharma, Advocate on behalf of opposite party no. 2 is taken on record.

¶2Heard learned counsel for the applicants, learned counsel for the opposite party no. 2 and learned A.G.A. for the State.

¶3The present application has been filed for quashing the impugned charge-sheet dated 11.04.2022 U/s 341, 332, 353, 427, 323, 504 I.P.C., Section 3(1)(da), 3(2)(5A) of SC/ST Act as well as summoning order dated 10.05.2022 and entire proceeding of S.T. No. 694 of 2022 arising out of Case Crime No. 191 of 2022 U/s 341, 332, 353, 427, 323, 504 I.P.C., Section 3(1)(da), 3(2)(5A) of SC/ST Act, Police Station-Kotwali City, District-Hardoi.

¶4Learned counsel for the applicants submits that due to some wrong impression, the F.I.R. of the case in question was lodged and charge-sheet was submitted by the Investigating Officer. He further submits that now, the issue has already been resolved between the parties by way of compromise and opposite party no. 2 does not want to prosecute the applicants.

¶5Learned A.G.A. vehemently opposes the prayer of applicants and submits that in the present case, the police official, who was deployed on the duty, was assaulted by the applicants, in this case, merely on the basis of affidavit of informant, prosecution cannot be withdrawn.

¶6At this stage, after advancing some arguments, learned counsel for the applicants prays that he may be permitted to withdraw the present application.
