¶1Heard learned counsel for the petitioner, learned A.G.A. for the State-respondents and perused the record.

¶2This petition has been filed with the following main prayer:- "(i) to issue an order or direction Civil Judge (S.D.) Malihabad, Lucknow (Opp. Party No.- 2) to decide the misc case no.102/2022 (Vipin Kumar Yadav Vs. State of U.P & others) which is pending since 01/02/2022 in The Court of Civil Judge (S.D.) Malihabad, Lucknow (Opp. Party No.- 2) misc case pending in The Court of Civil Judge (S.D.) Malihabad, Lucknow."

¶3Learned counsel for the petitioner submits that petitioner has filed Suit No.102/2022, under Section 383, 372 of Succession Act which is pending since 01.02.2022 before the court of Civil Judge (Senior Division) Malihabad, Lucknow. He submits that proceedings being summary in nature may be expedited at an early date.

¶4Learned A.G.A. has no objection.

¶5In view of above, without commenting on merits of the case, the petition stands disposed of with direction to the learned court below to adjudicate and decide the case preferably within a period of six months from the date of receipt of a certified copy of this order.
