Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties. Petition has been filed seeking a direction to the opposite parties for payment of regular pension without any deduction with effect from his date of superannuation on 31st May, 2023 after adjustment of amount paid as interim pension. It has been submitted that aforesaid pensionary benefits have been withheld by opposite parties only on the ground of alleged pendency of an appeal whereas only criminal proceedings are pending against petitioner without any conviction till date. For the aforesaid grievance, the petitioner has already submitted a representation dated 3rd November, 2023. At present learned counsel for the petitioner restricts his prayer for a final decision with regard to same. Considering innocuous prayer being made by learned counsel for petitioner and without entering into the merits of the case, opposite party No. 2 i.e. Executive Engineer, Nalkoop Khand, Ayodhya, District Ayodhya is directed to decide representation dated 3rd November, 2023 within a period of six weeks from the date a certified copy of this order is submitted before him.
