Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties. Petition has been filed seeking quashing of the order dated 31st May, 2023 whereby petitioner has been issued notice of superannuation on the basis of alleged incorrect date of birth entered in the department records as Ist June, 1963. Further prayer for correction of date of birth in the records has also been sought. It has been submitted that petitioner was initially engaged as Homeguard with opposite parties and even at the time of entering into service, his date of birth has entered in service records is Ist June, 1966 but at the time of digitization of records, it was incorrectly recorded as Ist June,1963. It is submitted that due to wrong entries, subsequently, a notice of retirement has been issued to him although service book still bears initial date of birth as Ist June, 1966. Considering submissions advanced by learned counsel for petitioner, he is granted liberty to file representation before opposite party No.2 i.e. Commandant General Homeguards, Headquarter, U.P.,Lucknow with regard to his grievance which shall be considered and decided by a reasoned order within a period of six weeks of submission of copy of this order along with representation.
