¶1Heard learned counsel for the petitioners and Sri S.B. Pandey learned Deputy Solicitor General of India assisted by Sri Deepanshu Das learned counsel for the Union of India.

¶2Learned counsel for the petitioners has stated that the land in question has already been settled in their favour under the orders passed by the competent authority from time to time.

¶3A show cause notice issued to the petitioner by the Government of India under Rule 4(1-ka) of the Enemy Property Rules, 2015 as to why the land in dispute may not be declared as enemy property has thus been questioned.

¶4Let a reply taking all the grounds be filed by the petitioners in response to the notice dated 29.9.2023 issued under Rule 4(1-ka) of the Enemy Property Rules, 2015. The reply filed, if any, shall be considered and decided by the competent authority on its own merit in accordance with law.

¶5It is made clear that if the proceedings for recall of any such orders placed reliance upon have been initiated by the State, the competent authority shall view the matter in the light of any such proceeding and proceed in furtherance of the impugned notice only after culmination of the proceedings on the recall applications.
