¶1Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

¶2Present application has been moved by the applicant to direct the Additional Chief Judicial Magistrate-III, Lucknow to decide the complaint case pending before him.

¶3Learned counsel for the applicant submitted that statement under Section 200 and 202 Cr.P.C. has already been recorded but till today, order under Section 203/204 Cr.P.C. has not been passed, therefore, a direction may be issued for passing an appropriate order.

¶4Learned A.G.A. has no objection on the aforesaid prayer of the applicant.

¶5Considering the submissions of learned counsel for the parties, going through the contents of application, as well as other relevant documents, the application is allowed and the A.C.J.M-III, Lucknow is directed to pass an appropriate order under Section 203/204 Cr.P.C., expeditiously.
