¶1Present petition has been filed with the following prayer: "a. a writ, order or direction in the nature of mandamus commanding the opposite party nos.2 & 3 to remove the illegal encroachment on public utility land i.e. Gata No.299, situated at Village Barsada, Pargana Dixir, Tehsil Tarabganj, District Gonda, which is recorded as Chak Marg in the revenue extract. ......."

¶2Learned Standing Counsel has produced instructions which are taken on record, which state that with regard to the offending constructions, proceedings under Section 67(1) of U.P. Revenue Code have already been initiated vide Case No.T202308300608305 and the next date fixed is 22.12.2023.

¶3Considering the said statement of the learned Standing Counsel, the present petition is disposed off directing respondents to decide Case No.T202308300608305 with all expedition, preferably within a period of three months.
