¶1Learned counsel for petitioner has filed supplementary affidavit today and the same is taken on record.

¶2Heard learned counsel for petitioner and learned Standing Counsel for State.

¶3Petitioner has approached this Court claiming that he has filed Revision Nos. 102(R)/G & M (U.P.) of 2023, 103 (R)/G & M (U.P.) of 2023 and 104 (R)/G & M (U.P.) of 2023 "Betwa Pulses & warehousing Pvt. Ltd. & Another Vs. District Magistrate Mahoba & Another". The said revisions are admitted and hearing of the revisions is also fixed for 07.12.2023. Meanwhile, District Magistrate, Mahoba by an e-notice dated

05.10.2023 has provided auctions of the area in dispute in the revisions by fresh auction. The disputed area is claimed to be at Sl. No.1, 2 and 8 of the e-notice dated 05.10.2023. The e-tender shall be opened lastly on 01.12.2023 and letter of Intent is likely to be issued within a period of one week thereafter. Thus, petitioner apprehends that any rights created with the third party may impact disposal of revisions.

¶4Learned Standing Counsel submits that revisions are already fixed for hearing on 07.12.2023 and would be decided within ten days thereafter.

¶5The aforesaid statement is taken on record.

¶6In the given circumstances, the District Magistrate, Mahoba, in case he finalizes tenders under notice dated 05.12.2023 with regard to Sl. No.1, 2, 8 in the said tender notice, he shall inform the parties concerned in writing that allotment, if any, shall be subject to final orders passed in the revisions of petitioner which shall be decided positively before 20.12.2023.
