By means of the instant petition, the petitioner has sought a direction in the nature of mamdamus commanding the respondent no. 2 to finalize the proceeding of case no. T202104710503901, Gaon Sabha Vs. Ramesh Chand Pandey, pending since 2022. On the last occasion, i.e., on 28.10.2023, the Standing Counsel prayed and was granted 10 days time to seek instruction that whether the order passed under Section 67(1) of UP Revenue Code, 2006 has been executed or not. The learned Standing Counsel on the basis of instruction of Tehsildar Amethi dated 08.11.2023 submits that the order dated

28.01.2022 is passed invoking the jurisdiction under Section 67(1) of the Code, 2006, and the same has been complied with as the encroachment over the Gaon Sabha land has been removed and it has specifically been mentioned that there is no unlawful possession over the land in question. After the aforesaid submissions, he has also placed the instruction dated 08.11.2023, which is taken on record and that shall be the part of the record.
