Petitioner has approached this Court claiming that Gaon Sabha and respondent no.6/Jal Nigam, District Amethi are constructing a water tank over the Abadi land owned by the petitioner. Learned counsel for the Gaon Sabha and the learned Standing Counsel raise a preliminary objection that the petitioner has an alternative remedy to file a suit for injunction. In the given facts and circumstances, as the said facts are disputed by the respondents, the present writ petition is disposed of with liberty to the petitioner to file a suit for injunction or to take appropriate proceedings before appropriate authority in accordance with law.
