Judgment

Court No. - 27 Case :- CRIMINAL MISC. BAIL CANCELLATION APPLICATION No. - 89 of 2022 Applicant :- Abdul Bari Opposite Party :- State Of U.P. Thru Addl. Chief Secy. Home And Another Counsel for Applicant :- Shamshad Ahmad,Anshu Singh,Birendra Pratap Singh,Krishna Kumar Singh Counsel for Opposite Party :- G.A.,Mohd. Nafees,Pawan Kumar Mishra Hon'ble Brij Raj Singh,J. Shri Krishna Kumar Singh, learned counsel for the applicant at the outset states that the applicant does not want to press the application for cancellation of bail. However, he has submitted that after bail granted to the opposite party no. 2, he has threatened the complainant to do compromise and in this regard, he has filed FIR (Annexure 9). Learned counsel submitted that he is creating pressure to make compromise in the case. He further submitted that there is one case also lodged against opposite party no.2 which is Annexure 11 and this fact also indicates that opposite party no. 2 is having tendency of criminal nature therefore, trial Court may be directed to conclude the case within specified time. In view of the aforesaid submission made by Shri Krishna Kumar Singh, learned counsel for the applicant, the application for cancellation of bail is dismissed as not pressed. However, I direct the trial Court to conclude the trial within eight months without granting any adjournment to opposite party no.2. It is made clear that in case opposite party no.2 is tampering the evidence or threatening the applicant in future, it would be a ground for cancellation of bail.
