Heard Shri Rudra Mani Shukla, learned counsel for the petitioner as well as learned Standing Counsel on behalf of state - respondents. It has been submitted by the learned counsel for the petitioner that in the open meeting of the gram panchayat held on 11.09.2023, the name of the petitioner was proposed for being allotted a fair price shop at village Behlhari Buzurg, Vikas Khand Chhapia, Tehsil Mankapur, District Gonda. It is in the aforesaid circumstances that the proposal was pending before Tehsil Level Committeee for nearly two months and no decision was taken and, accordingly, this Court had directed the learned Standing Counsel to seek instructions as to whether any decision has been taken by the said Committee or not ? Learned Standing Counsel on the basis of the written instruction received by the SDM Mankapur, Gonda has informed this Court that the proposal dated 11.9.2023 has been duly considered by the Tehsil Level Committee and there was certain illegality in the said proposal consequent to which the said proposal has been cancelled and the matter has been remitted to the Gram Sabha for passing a fresh proposal for allotment of the shop. At this stage learned counsel for the petitioner submits that no further cause of action subsists in light of the fact that the proposal has been rejected and, accordingly, he does not wish to press the petition any further.
