Submission of learned counsel for the petitioner is that the petitioner has filed Divorce Suit No.1259 of 2021, under Section 13(1) of Hindu Marriage Act in the year 2021. Till date neither the written statement has been filed nor the case is proceeding. Perusal of the order sheet annexed by the petitioner indicates that the petitioner is not complying the order of interim maintenance, therefore he is not entitled for any relief, at this stage, in a suit of 2021. However, in case he pays the whole interim maintenance to the respondent if there is no legal impediment and thereafter moves an application for expeditious disposal of suit showing urgency, the same shall be considered by the concerned court in accordance with law.
