Petition has been filed seeking a direction to opposite parties to consider and decide petitioner's representation dated 16.08.2023 for grant of family pension and other service benefits which were due to petitioner's husband late Abdul Salam @ Abdus Salam particularly in view of the fact that earlier order dated

27.12.2002 dismissing petitioner's husband from service was ultimately quashed vide judgment and order dated 21.12.2010 passed in Special Appeal No.191 of 2007. Civil Appeal No.2603 of 2012 before Hon'ble the Supreme Court was also rejected vide judgment and order dated 09.08.2023 whereafter the aforesaid representation was filed which is still pending consideration. At present learned counsel for petitioner restricts his prayer for a final decision with regard to same. Considering innocuous prayer being made by learned counsel for petitioner and without entering into the merits of the case, opposite party No.2 i.e. District Magistrate, Lucknow is directed to consider and decide representation dated 16.08.2023 by reasoned and speaking order within a period of six weeks from the date a certified copy of this order is produced before said authority. In case petitioner is found entitled for the aforesaid benefits, the said authority shall ensure payment of such benefits to petitioner within a period of two months thereafter.
