Judgment

Court No. - 20 Case :- WRIT - A No. - 9219 of 2023 Petitioner :- Dr. Vandana Mahesh Chourasiya Respondent :- State Of U.P. Thru. Addl. Chief Secy. Medical Health/Family Welfare Deptt. Lko. And 2 Others Counsel for Petitioner :- Deepak Dwivedi Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J. Heard. Petition has been filed seeking a direction to concerned authorities to pass appropriate orders pertaining to regularization of ad hoc services of petitioner in terms of relevant rules and for payment of post retiral dues including pension and all consequential benefits in lieu thereof. It has been submitted that petitioner was initially engaged in service on 2nd August 1989 by means of written order and has subsequently superannuated on 31st July, 2023 after having rendered almost 34 years of service as a Dental Surgeon with opposite parties but has been deprived of service benefits due to the fact that his services were not regularized. Learned counsel has submitted that in similar circumstances, appropriate orders were passed by this Court in the case of Dr. Smt. Shanti Sati Rai and others versus State of U.P. and others in writ petition No. 1109 (S/B) of 2008 and petitioner is also entitled for the same benefit. For the aforesaid grievance, petitioner has already submitted a representation but seeks liberty to file a fresh representation. At present learned counsel for petitioner restricts his prayer for a final decision with regard to same. Considering innocuous prayer being made by learned counsel for the petitioner and without entering into the merits of the case petitioner is granted liberty to file a fresh representation before opposite party No. 1 or any other concerned authority. In case such a representation is filed, the same shall be decided by a reasoned and speaking order within with period of eight weeks from the date a copy of this order is produced before the said authority. With the aforesaid observations, the writ petition stands disposed of. Order Date :- 1.12.2023 prabhat High Court of Judicature at Allahabad, Lucknow Bench
