Submission of learned counsel for the petitioner is that the son of the petitioner has ousted her from her house, therefore she has filed an application under Section 5 of the Maintenance and Welfare of Parents and Senior Citizens Act 2007 bearing No.5794 of 2023(Shiv Devi versus Pawan Kumar Saini), which is pending before the Sub Divisional Officer, Lucknow. Accordingly she prayed that a direction may be issued for disposal of the application within some short stipulated period. To which there is no objection by the other side. Considering the nature of order proposed to be passed, requirement of issuance of notice to the opposite parties no.3 and 4 is dispensed with. In view of above, without entering into the merits of the case, the petition is disposed of with direction to the opposite party no.2/Sub Divisional Officer, Lucknow to consider and dispose of the Case No.5794 of 2023 expeditiously, say within a period of three months from the date of production of certified copy of this order in accordance with law without granting unnecessary adjournment to either of the parties,if there is no impediment and subject to cooperation by the petitioner.
