Sri Rajnish Tiwari,Advocate holding brief of Sri Avinash Tiwari, learned counsel for the petitioner submits that the petitioner has filed a Divorce Petition No.3575 of 2019 under Section 13 of Hindu Marriage Act (Mukul Rishi versus Kiran Gautam). The case is at the stage of examination of witness. However, since the case is not proceeding, therefore, a direction may be issued for disposal of the Divorce Petition. Perusal of the order sheet annexed by the petitioner indicates that the suit is at the stage of prosecution witness and the cross examination of PW 1 was completed on 10.08.2023. Thereafter twice date has been fixed for examination of remaining witnesses but it appears that the petitioner has not produced the witnesses, therefore, the same could not be recorded. At this stage, when the petitioner himself is not assisting the Court in disposal of the petition, no direction can be issued for disposal of the suit of the year 2019. Dismissed accordingly.
