Heard learned counsel for the petitioner and learned AGA for the State. Notices to respondent no. 2 and 3 are dispensed with in view of the proposed order. By this petition, the petitioner has prayed for the following relief:- "Wherefore, it is most respectfully prayed that this Hon'ble Court may graciously be pleased to issue a direction to civil Judge (J/D)/F.T.C. Sultanpur to consider & decide Case No. 224 of 2022 Under Section 12 of D.V. Act (Asha Devi and another Vs. Girish Dutt Sharma) which is pending before Civil Judge (J/D)/F.T.C. Sultanpur since 20.6.2022 and it is prayed to this Hon'ble Court to fix a stipulated time period for disposal of the above-cited case in question." On due consideration to the fact that case under Section 12 of DV Act is pending since June, 2022 and the same has not been decided yet, it would be appropriate to direct the Civil Judge (J/D)/F.T.C. Sultanpur for disposing of the said application in view of the provisions of Section 12(5) of Protection of Women from Domestic Violence Act, 2005. Accordingly, the petition is disposed of directing Civil Judge (J/D)/F.T.C. Sultanpur to expedite and decide Case No. 224 of 2022 Under Section 12 of D.V. Act (Asha Devi and another Vs. Girish Dutt Sharma), preferably within a period of sixty days from the date of receipt of certified copy of this order. Order Date :- 1.12.2023 R.C.
