Judgment
Court No. - 9 Case :- WRIT - C No. - 10496 of 2023 Petitioner :- Smt. Antima Devi Respondent :- Union Of India Thru. Its Secy. , Petroleum Natural Gas , New Delhi And Others Counsel for Petitioner :- Prabhat Kumar,Azad Khan Counsel for Respondent :- A.S.G.I.,Shikhar Anand Hon'ble Rajan Roy,J. Hon'ble Manish Kumar,J. Heard Shri Prabhat Kumar, learned counsel for the petitioner, learned Assistant Solicitor General of India, learned counsel for the opposite party no. 1 and Shri Shikhar Anand, learned counsel for the opposite parties no. 2 and 3. After hearing learned counsel for the parties what comes out is that petitioner had applied for grant of retail dealership and in this process he had offered a land, which, he had taken on lease from the owner, however, subsequently the said owner sold out the said land to a third person who raised an objection in this regard. It is said that the company confronted the petitioner whereupon he proposed to offer some other land, however, this was required to be done within 90 days. This was not done, instead, it was offered after six months, therefore, the impugned order dated 25.04.2023 had been passed. The letter of intent issued to the petitioner, had been withdrawn. The submission of learned counsel for the petitioner is that as he is willing to offer other land the same may be considered by the Company. This is not a matter where the writ Court should interfere under Article 226 of the Constitution of India, as, these matters are governed by Rules and Regulations as applicable to such transactions, however, if the company itself is of the view that it can accept the belated offer of the petitioner this order will not come in its way. With the aforesaid observations/directions, the writ petition is disposed of. . (Manish Kumar,J.) (Rajan Roy,J.) Order Date :- 2.12.2023 R.K.P. High Court of Judicature at Allahabad, Lucknow Bench
