1.The present petition has been filed with the following prayer: "(i) Issue a writ order or direction in the nature of Mandamus Commanding the respondents concerned to get vacate the land bearing plot no. 81/0.0730 hectare situated at Gaonsabha-Kachhwan Bujurg, Pargana-Sadullanagar, Tehsil-Mankapur, District-Gonda recorded as Chakmarg in revenue record i.e. a public utility land but encroaching upon 3/4 portion of the land private respondents have planted teak trees and illegally using the same as their private property with the collusion of its custodian in the interest of justice."

¶2Learned Standing Counsel has produced the instructions to demonstrate that for removal of the trees from the Chakroad, the same has to be auctioned and the proceedings shall be taken thereupon.

¶3In view of the said statement, the present petition is disposed off directing the respondent to complete the proceedings, so proposed, in accordance with law with all expedition.
