¶1The present petition has been filed with the following prayer: "(i) Issue a writ, order or direction in the nature of mandamus commanding and directing the opposite parties no.2 to 4 to remove the encroachment and illegal occupation of private opposite parties no.6 to 10 over the gata no. 1507 Cha=2.0970 hectare, situated at village-Chafariya, Pargana and Tehsil-Bahraich, District-Bahraich, which is recorded as Banjar in the revenue record.

(ii) Issue a writ, order or direction in the nature of mandamus commanding and directing the opposite party no.4 i.e. Assistant Collector (First Class) / Tehsildar Bahraich, District-Bahraich to look into the matter of restoration of the land of Gram Sabha, situated at village-Chafariya, Pargana and Tehsil-Bahraich, District-Bahraich, in pursuance of the applications dated 13.09.2023, moved by the petitioner, contained as Annexure No. 4 to this writ petition."

¶2Learned Standing Counsel has produced the instructions to demonstrate that persons were instituted a part of the land, however, the proceedings are undergoing to relocate them after the allotment under Section 64 of the U.P. Revenue Code, 2006.

¶3In view of above, the present petition is disposed off directing the respondents to take steps as proposed and informed though instructions dated 01.12.2023, with all expedition preferably within a period of six months from today.
