The petitioner's transfer has been cancelled by the impugned order dated 02.07.2023 as she had submitted incorrect medical certificates to get herself transferred outside the district taking advantage of the policy, according to which, certain marks were allotted on account of illness. The certificates submitted by her not having been found as per G.O. dated 02.06.2023, the benefit has been withdrawn. On being confronted, learned counsel for the petitioner could not point out any error in the impugned order nor could he successfully refute the recitals contained therein. On being asked repeatedly to demonstrate error in the order, petitioner's counsel could not refer to any pleading or document to do so. Therefore, the Court sees no reason as to why the benefit of the order annexed as Annexure no.14 should be given to the petitioner especially as the said order merely directs disposal of representation. Such orders cannot be passed casually unless prima facie petitioner satisfies it or the Court itself finds it necessary to do so. Accordingly, the writ petition is dismissed. (Rajan Roy,J.)
