In terms of order dated 08.11.2023 passed by this Court, the opposite party no. 2 is present before this Court along with Shri M. Usman Siddique, Advocate. Shri M. Usman Siddique, learned counsel for opposite party no. 2 has filed counter affidavit in Court today which is taken on record. He states that parties have agreed to settle all the disputes on the basis of agreement in terms of compromise deed, the amount of Rs. 7,50,000/- mentioned in the compromise deed has been paid by the applicant and the opposite party no. 2 is also not willing to contest the litigation for which quashing is sought. In view of the said affidavit which has been filed today along with compromise application, the entire proceedings of impugned Criminal Case No. 2642/2022 arisiting out of Case Crime No. 1241/2019 under Sections 332, 353, 504 & 506 IPC, Police Station - Kotwali, District - Unnao as well as cognizance/summoning order dated 02.05.2022 passed by Chief Judicial Magistrate, Unnao are quashed and the application is allowed. Presence of opposite party no. 2 is exempted. Learned counsel for the applicant further states that his client shall pay an amount of Rs. 5,000/- on account of out of pocket expenses to the opposite party no. 2.
