In terms of order dated 19.10.2023, the parties are present before this Court. In terms of orders dated 19.10.2023 and 23.05.2023 passed by this Court, learned counsel for the applicants has produced the demand drafts totaling an amount of Rs. 14,65,000/- being draft nos. 001896, 000414 and 001810 of Bank of India. The same are handed over to the counsel for opposite party no. 2 in Court today for being remitted to the opposite party. In view of full and final settlement arrived between the parties,the entire proceedings of complaint case no. 113/2017 under Section 138 N.I. Act, P.S. Hazratganj, District - Lucknow pending before Additional Court No. 11, Lucknow as well as impugned summoning order dated 08.02.2018 are quashed and application is allowed. Learned counsel for the opposite party takes undertaking before this Court that his client will withdraw the cases filed before RERA Authority and other at Gwalior, Madhya Pradesh by moving appropriate application.
