Judgment

Court No. - 9 Case :- WRIT - A No. - 9032 of 2023 Petitioner :- Ajay Kumar Respondent :- State Of U.P Thru. Prin. Secy. Panchayati Raj Civil Secrt.Lko. And 2 Others Counsel for Petitioner :- Saakshi Pandey,Bharat Kumar Dixit Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Heard. The petitioner is aggrieved by repeated transfer. The first transfer was effected on 30.09.2022. The second transfer order was passed on 31.07.2023 and within two months, he has been transferred for the third time on 08.09.2023 to another Gram Panchayat, albeit, in the same block. The submission is that he is a low paid employee, a sweeper and he cannot be shifted frequently from one Gram Panchayat to another. Prima facie, the contention appears to be correct. However, without interfering with the impugned order of transfer, the D.P.R.O., Amethi is directed that the petitioner should not be transferred frequently from one Gram Panchayat to another. He should be allowed to stay in the Gram Panchayat for a reasonable time as is done in the case of other persons unless there are good reasons for transferring the petitioner elsewhere which should be reduced in writing and communicated to him. A low paid employee if transferred frequently it can derail his family life and cause grave hardship. He should keep this in mind for the future. With these observations/ direction, the writ petition is disposed of. (Rajan Roy,J.) Order Date :- 4.12.2023 Shanu/- High Court of Judicature at Allahabad, Lucknow Bench
