Judgment

Court No. - 16 Case :- CRIMINAL REVISION No. - 1325 of 2023 Revisionist :- Mohd. Aslam Opposite Party :- State Of U.P. Thru. Secy. Home, Lucknow And 2 Others Counsel for Revisionist :- Suresh Chandra Srivastava,Vaibhav Srivastava Counsel for Opposite Party :- G.A. Hon'ble Subhash Vidyarthi,J.

¶1Heard Sri Suresh Chandra Srivastava, the learned counsel for the revisionist and Sri S.P. Tiwari, the learned AGA-I for the State and perused the records.

¶2By means of the instant revision filed under Section 19(4) of the Family Courts Act, 1984, the revisionist has assailed the validity of the order dated 21.09.2023 passed by the Additional Principal Judge, Forth, Family Court, Sultanpur whereby the Family Court has ordered the revisionist to pay Rs. 2,000/- per month as interim maintenance to the revisionist's wife and daughter.

¶3A perusal of the order dated 21.09.2023 indicates that it has been passed after giving an opportunity to the applicant to file objections against the application and after taking into consideration the objections filed by him.

¶4The order is interim in nature and the applicant has an opportunity to get the same varied by the Family Court itself.

¶5As the order has been passed after hearing the applicant and after taking into consideration his objections, there appears to be no jurisdictional error therein warranting interference of this court in exercise of its revisional jurisdiction.

¶6The revision lacks merit and is dismissed at the admission stage itself. Order Date :- 4.12.2023 Pradeep/- High Court of Judicature at Allahabad, Lucknow Bench
