The formal ceremonies related to the marriage were performed on 12.12.2015 and her family members had spent a huge amount in the wedding. ¶4In the affidavit filed in support of the anticipatory bail application it has been contended that the applicant is innocent, he has been implicated by the informant because of some matrimonial disputes and he has no criminal history.

¶5The learned A.G.A. has opposed the bail application but on the basis of instructions provided to him he has submitted that the allegation of commission of offences under Sections 328 and 377 I.P.C could not be established during investigation and a charge sheet has already been submitted against the accused persons on 15.11.2023.

¶6Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that there appears to be a matrimonial dispute between the parties; that some serious allegations leveled by the informant against the applicant could not be established during investigation and the investigation already stands concluded and a charge sheet has been submitted for offences which carry a maximum punishment of imprisonment upto 7 years and that the applicant has no criminal history, I am of the view that the aforesaid facts are sufficient for making out a case for granting anticipatory bail to the applicant.
