Judgment
Court No. - 10 Case :- CRIMINAL MISC. WRIT PETITION No. - 8796 of 2023 Petitioner :- Dhruv Narayan Shukla And Others Respondent :- State Of U.P. Thru. Prin. Secy. Home Deptt. Lko And Others Counsel for Petitioner :- Rakesh Dwivedi Counsel for Respondent :- G.A.,Amit Singh,Prashant Pandey,Sushil Kumar Gupta Hon'ble Mrs. Sangeeta Chandra,J. Hon'ble Narendra Kumar Johari,J. Heard learned counsel for the petitioners, learned A.G.A. for the State/respondents and Shri Prashant Pandey, learned counsel for the respondent No.4. Respondent No.4 is also present before this Court. Learned counsel for the respondent No.4 has filed counter affidavit, which is kept on record. On a specific query made, respondent No.4 states that he does not wish to compromise with the petitioners as he says that there is no land left with the petitioners and the petitioners have sold off all the land, therefore, the compromise with the petitioners would not be fruitful as the petitioners are not in a position to return any land to the respondent No.4. We have gone through the impugned F.I.R. and finds cognizable offence to be made out against the petitioners. Accordingly, the writ petition is dismissed. Interim order, if any, stands vacated. The amount of Rs.50,000/- that the petitioners have deposited in compliance of our earlier order, shall be returned to the petitioners on an appropriate application being made by learned counsel for the petitioners.
