¶1Petitioner has approached this Court challenging the impugned order dated 12.01.2023 whereby certain dues has been raised against the petitioner by the respondent no. 5-Executive Engineer, Zone-3, Lucknow Development Authority, Vipin Khand, Gomti Nagar, Lucknow.

¶2Learned counsel for the petitioner submits that the opportunity of hearing was not given to the petitioner before passing the impugned order.

¶3Shri Ratnesh Chandra, learned counsel for the Lucknow Development Authority, as per instructions could not dispel the position.

¶4In view of above, the order dated 12.01.2023 and consequential orders thereof are hereby set aside. It shall be open for the respondent no.3 to pass a fresh order, if he so desires by affording due opportunity of hearing to the petitioner.
