Court No. - 4 Case :- CONTEMPT APPLICATION (CIVIL) No. - 1740 of 2019 Applicant :- Smt. Ram Devi Mishra Opposite Party :- Poonam Superintendent Of Police Lakhimpur Kheri Counsel for Applicant :- Ajeet Kumar Singh Hon'ble Rajesh Singh Chauhan,J.
¶1Heard Ms. Ritu Singh holding brief of Sri Ajeet Kumar Singh, learned counsel for the petitioner and Sri Ram Swaroop, learned Standing Counsel.
¶2Sri Ram Swaroop has drawn attention of this Court towards the order of Writ Court dated 04.10.2018 passed in Writ Petition No. 28624 (SS) of 2018 which reads as under: "Submission of learned counsel for the petitioner is that the husband of the petitioner had retired from service on 31.07.2010 while he was working under opposite party no.6. The pension was sanctioned to him by means of Annexure-2 and it was being paid. The husband of the petitioner had gone to the religious pilgrimage but he did not returned back. The petitioner had lodged a report regarding his missing but no whereabouts is known till date. Therefore the petitioner had moved a representation to the opposite party no.3 for payment of the pension of the petitioner on 13.12.2017 but no decision has been taken till date. Therefore, learned counsel for the petitioner prayed for a direction to the opposite party no.3 to consider and dispose of the representation of the petitioner within some short stipulated period. Learned Standing Counsel has no objection to the prayer made by the learned counsel for the petitioner. The writ petition is disposed of with the direction to opposite party no.3 to consider and dispose of the representation of the petitioner within a period of six weeks from the date of production of certified copy of this order."
¶3Learned Standing Counsel has further drawn attention of this Court towards the order dated 28th of November, 2023, passed by the sole contemnor, wherein it has been indicated that since the husband of the petitioner was retired from the district Unnao, therefore, she should approach the Superintendent of Police, Unnao for getting of dues e.g. family pension etc. The aforesaid letter has been forwarded to the Superintendent of Police, Unnao by S.P. Kheri for necessary action, therefore, learned Standing Counsel has stated that if the petitioner approaches the Superintendent of Police, Unnao to get her family pension etc, the appropriate order may likely to be passed by such authority, inasmuch as S.P., Unnao has been informed for doing the needful. The copy of order dated 28th of November, 2023 is taken on record and the same has also been provided to learned counsel for the petitioner.
¶4In the wake of aforesaid development, nothing remains to be adjudicated in the present contempt petition.
¶5Accordingly, the instant contempt petition is dismissed.
¶6Notice, if any, stands discharged. [Rajesh Singh Chauhan,J.] Order Date :- 6.12.2023 kkv/ High Court of Judicature at Allahabad, Lucknow Bench
