Judgment

Court No. - 8 Case :- WRIT - A No. - 9345 of 2023 Petitioner :- Dinesh Kumar Gupta Respondent :- State Of U.P. Thru. Secy. Information And Public Relations Deptt. Lko. And 2 Others Counsel for Petitioner :- Anoop Vajpayee,Atul Kumar Yadav Counsel for Respondent :- C.S.C. Hon'ble Pankaj Bhatia,J. Heard learned counsel for the petitioner, learned Standing Counsel for the State respondent and perused the record. The present writ petition has been filed by the petitioner with the following prayer: "(i) Issue a writ, order or direction in the nature of mandamus thereby commanding and directing the opposite parties specially opposite party no. 3 to consider the matter of the petitioner for promotion on the post of Editor from the post of Deputy Editor treating his appointment with effect from 2012, in the interest of justice." The contention of the counsel for the petitioner is that despite there being post available, the opposite party no. 3 is not considering the case of the petitioner for promotion. Considering the fact that the opposite party no. 3 has to pass an order, the present writ petition is disposed of directing the petitioner to approach the opposite party no. 3 by filing a fresh application along with copy of this order. In case, any such application is filed, the grievance of the petitioner shall be considered and decided in accordance with law by passing a reasoned order expeditiously preferably within a period of six weeks from the date of production of certified copy of this order.
