¶1Heard learned counsel for petitioner and the learned Standing Counsel for the State/ respondents.

¶2This writ petition has been filed by the petitioner for the following main prayers:- "I. Issue a writ, order or direction in the nature of mandamus commanding to the opposite party no.2, i.e. District Magistrate, Barabanki to decide the claim of the petitioner according to law preferred under "Krishak Durghatna Bima Yojana" which is pending before him. II) Issue a writ, order or direction in the nature of mandamus commanding to the opposite party no.2 to release the payment to the petitioner under the "Krishak Durghatna Bima Yojana."

¶3Learned counsel for petitioner has submitted that father of the petitioner died due to the Kedarnath Flood Disaster on

10.06.2021. Petitioner is entitled for the benefit of government order issued for granting benefit under the Krishak Durghatna Beema Yojana.

¶4Learned counsel for the petitioner states that District Magistrate concerned who is head of the District Level Committee may be directed to decide the claim of the petitioner.

¶5Learned Standing Counsel has no objection to the prayer made by the petitioner.

¶6In view of the aforesaid, the present writ petition is disposed of with direction to respondent no.2-District Magistrate, Barabanki to take decision on the claim of the petitioner, in accordance with law, if there is no legal impediment, within a period of three months from the date a certified copy of this order is served upon him.
