Gonda And 2 Others Counsel for Petitioner :- Pankaj Kumar Singh Hon'ble Rajnish Kumar,J. Supplementary affidavit filed by learned counsel for the petitioners is taken on record. Sri Pankaj Kumar Singh learned counsel for the petitioners submits that the petitioners have filed suit for eviction and declaration Regular Suit no.546 of 2009 (Ghanshyam vs Ram Dheeraj and others). The petitioners have filed an application under Order 39 Rules 1 and 2 and under Sections 151/141 C.P.C for temporary injunction on 26.08.2021 registered as 51Ga2, on which objections were invited, but the same has not been disposed of till date and now 11.12.2023 is fixed for disposal of the said application along with other applications. He makes an innocuous prayer for direction to the concerned court for disposal of the application 51Ga2 expeditiously within some short stipulated period. Considering the nature of the order proposed to be passed in this petition, issuance of notice to opposite party nos.2 and 3 is dispensed with. The opposite party no.1 is the court concerned. Without entering into the merits of the case, the petition is disposed of with a direction to the court concerned to consider and dispose of the application 51Ga2 filed in Regular suit no.546 of 2009 expeditiously and preferably on the date fixed or within a period of four weeks thereafter, after affording opportunities to the parties in accordance with law and without granting any unnecessary adjournment to either of the parties.
