Judgment

Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 4484 of 2023 Petitioner :- Mohan Lal And 3 Others Respondent :- The Civil Judge (Sr.Div.) District Lakhimpur Kheri And 2 Others Counsel for Petitioner :- Deo Raj Singh Hon'ble Rajnish Kumar,J. C.M.Application No.IA/3/2023 Shri Deo Raj Singh, learned counsel for the petitioner submits that he does not want to press this application, therefore it may be dismissed as not pressed. In view of above, the application is dismissed as not pressed. In Re;Petition Supplementary affidavit filed by learned counsel for the petitioner is taken on record. Learned counsel for the petitioner submits that the petitioner has filed Regular Suit No.238 of 2016 for permanent injunction alongwith an application bearing No.7Ga2, under Order 39 Rule 1 and 2 for temporary injunction, but the said application has not been disposed of till date, on account of filing of one or another application by the respondents, who are defendants in the Suit though the application is being listed repeatedly and they are making hindrance on the spot, therefore he makes an innocuous prayer for a direction for disposal of his application no.7Ga2 within some short stipulated period. Considering the nature of order proposed to be passed issuance of notice to opposite parties no.2 and 3 is dispensed with. The respondent no.1 is the court concerned. Without entering into the merit of the case, the petition is disposed of with direction to the court concerned to consider and dispose of the temporary injunction application No.7Ga2 filed under Order 39 Rule 1 and 2 CPC by the petitioner alongwith Regular Suit No.238 of 2016 expeditiously and preferably within a period of six weeks from the date of production of a certified copy of this order after affording opportunity to the parties in accordance with law and without granting unnecessary adjournment to either of the parties.. ...........................................(Rajnish Kumar,J.)
