At the very outset, learned counsel appearing for the applicant says that on account of some formal defect crept in the instant application, he may be permitted to withdraw it with liberty to the applicant to file a fresh application on the same cause of action with proper pleadings and evidence. The aforesaid has not been opposed. In view of the above, the instant application is dismissed as withdrawn with liberty, as prayed for.
