Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 6144 of 2023 Petitioner :- Anil Kumar Maurya Respondent :- State Of U.P. Thru. Prin. Secy. Revenue U.P. Lko. And 18 Others Counsel for Petitioner :- Dharmendra Pratap Singh,Anil Kumar Tiwari Counsel for Respondent :- C.S.C. Hon'ble Rajnish Kumar,J. On an objection raised by learned Standing Counsel that the State of U.P. has wrongly been impleaded, Shri Dharmendra Pratap Singh, learned counsel for the petitioner submits that he may be permitted to delete the State of U.P. from the array of the parties. In view of above, learned counsel for the petitioner is permitted to delete the State of U.P. from array of the parties and re-number respondent no.2 as 1 onwards during course of the day. Learned counsel for the petitioner submits that the petitioner has filed Regular Suit No.636 of 2022 for permanent injunction alongwith an application under Order 39 Rule 1 and 2 read with Section 151 CPC, but the same has not been disposed of till date and the case is now listed on 16.01.2024, whereas the respondents who are defendants in the Suit have already put in appearance. He makes an innocuous prayer for a direction to the court concerned to dispose of the application for temporary injunction within some short stipulated period. Considering the nature of order proposed to be passed issuance of notice to opposite parties no.2 to 4 is dispensed with. The respondent no.1 is the court concerned. Without entering into merit of the case, the petition is disposed of with liberty to the petitioner to move application for expeditious disposal of the interim injunction application before the concerned court. In case any such application is moved within a period of one week from today, the same shall be considered and disposed of within a period of two weeks thereafter and the court concerned shall proceed accordingly in accordance with law. . ...........................................(Rajnish Kumar,J.)
