Judgment

Court No. - 7 Case :- WRIT - A No. - 1756 of 2022 Petitioner :- Ram Dhani Pal Respondent :- State Of U.P. Thru. Prin. Secy. Social Welfare Civil Secrtt. Lko. And 4 Others Counsel for Petitioner :- Salil Kumar Srivastava,Digvijay Mani Tripathi Counsel for Respondent :- C.S.C.,Prabhu Ranjan Tripathi Hon'ble Abdul Moin,J.

¶1Heard learned counsel for the petitioner, learned Standing Counsel appearing for the respondents no.1 to 3.

¶2Despite notice being issued to respondents no.4 and 5 and counter affidavit having been filed on their behalf by Sri Prabhu Ranjan Tripathi, learned counsel, and the list having been revised, nobody has put in appearance on behalf of respondents no.4 and 5.

¶3Since the matter is too trivial to keep pending before this Court, the same is being decided at this stage, to which learned Standing counsel has no objection.

¶4Instant writ petition has been filed praying for a mandamus commanding the respondents to release the pensionary benefits including the retiral dues.

¶5The contention of learned counsel for the petitioner is that despite the petitioner having retired on attaining the age of superannuation on 31.12.2020, his pension and other retiral dues have still not been paid.

¶6Learned counsel for the petitioner after arguing at some length submits that with regard to the relief sought in the writ petition, the petitioner may be permitted to submit a fresh representation before respondent no.1 which may be directed to be decided within a time frame fixed by this Court to which learned Standing Counsel has no objection.

¶7In view of the above, it is provided that in case the petitioner submits a representation within two weeks from today before respondent no.1 then respondent no.1 shall endevour to decide the same by means of a reasoned and speaking order within a further period of eight weeks from the date of submission of the representation along with certified copy of this order.

¶8With the aforesaid direction, writ petition is disposed off.

¶9It is made clear that this Court has not gone into the merits of the case. Order Date :- 8.12.2023 A. Katiyar High Court of Judicature at Allahabad, Lucknow Bench
